2.A. Superintendent's proposed priorities for addressing the anticipated state funding shortfall.

3. Motion to go into Closed Session: If the Board votes to go into closed session, then such closed session shall be held pursuant to Chapter 551 of the Texas Government Code, the expected specific sections of which are listed herein below:

3.A. [Section 551.071, Government Code - Consultation with Attorney:] For a private consultation with Board's attorney with respect to pending or contemplated litigation or settlement offers, and/or on matters where the attorney's duty to the Board, under the Texas Disciplinary Rules of Professional Conduct of the state Bar of Texas, clearly conflicts with the open government provisions of Chapter 551 of the Government Code, to wit:

3.A.1. Consultation with attorney regarding legal issues associated with proposals to address the anticipated state funding shortfall for the 2011-2012 budget year.

3.A.2. Consultation with attorney regarding pending litigation in Civil Action SA-10-CV-0571-XR in preparation for court-required mediation.

4.A. Discussion and direction to the Superintendent in response to the Superintendent's list of priorities for addressing the anticipated state funding shortfall for the 2011-2012 budget year.
