Discussion:
Mayor Eickmeier announced that a copy of the Agenda for this meeting is posted on the north wall of the Municipal Building and copies are available on the north wall where a copy of the Open Meetings Act is also posted for public inspection. He also noted that any citizen wishing to address the Council should come to the podium, state their name and address and limit their comments to five minutes. All remarks should be directed to the Mayor/Chairperson, who will then determine who will make any appropriate response. The City of Seward reserves the right to adjust the order of items on this agenda if necessary and may elect to take action on any of the items listed.

Rationale:
This is an Open Meeting of the Seward Nebraska Governing Body. The City of Seward abides by the Nebraska Open Meetings Act in conducting business. A copy of the Nebraska Open Meetings Act is displayed on the north wall of this meeting room facility as required. Disclosure of meeting recording processes is posted in the Meeting Room. A participant sign-in sheet is available for use by any Citizen addressing the Council. Presenters shall approach the podium, state their name & address for the Clerk’s record and are asked to limit remarks to five minutes. All remarks shall be directed to the Mayor who shall determine by whom any appropriate response shall be made. 1. Request for Approval of the Updated Rules & Regulations for the Civil Service Commission - Chief of Police Peters

Discussion:
The Civil Service Commission operates in accordance to approved rules and regulations as specified by Nebraska Statute. The last update to the current Commission rules and regulations occurred in April 2014. Chief of Police Brian Peters has completed a review and provided a recommendation to the Civil Service Commission for an updated version. Consequently, the updated rules and regulations have been reviewed, approved and recommended to the Council by the Civil Service Commission at their June 2, 2022 meeting.

2. Routine Update of the Following Job Description: City Administrator - HR Director Bargmann

The HR Director continues to officially review job descriptions that exceed five years since last update. The job description presented tonight, for the City Administrator position, was last updated in July 2007. The request is for Council consideration and approval of the updated job description for this appointed position.

As directed by the Nebraska Department of Revenue, the City Council will need to pass an ordinance signaling their recognition of the May 10th Ballot results and indication of the date in which the additional 0.5% sales and use tax will be implemented. City Administration is proposing an imposition of this tax as of January 1, 2023 and requests approval of the attached ordinance which will establish this date.

4. Consideration of a Resolution Establishing a Policy for Application to Construct Utilities in City Right-of-Way and Affix the Amount of Fees Charged - City Administrator Butcher

Discussion:
The resolution presented updates fees associated with the permitting of work/construction performed within the City right-of-way (ROW). Upon review by City Administration it was determined that our current fees are not proportional to the work performed by those whom review the permit and that similar fees in other communities were lower than those charged in the City of Seward.

5. Award Community Development Block Grant (CDBG) Downtown Revitalization Program (21DTR011) Forgivable Loans - City Administrator Butcher

Discussion:
The next phase of the CDBG-DTR funds (21DTR011) was awarded to the City of Seward in early 2022 to be distributed to downtown business applicants. Following the revision of the program guidelines, the application due date was April 15, 2022 at 10 AM with a total of 17 applications received. The following applications were approved by the LB840/DTR Committee and have completed the Site Specific Tier II Environmental Evaluation by Kelly Gentrup (SENDD) our CDBG Certified Administrator. These applications were timely filed within the first come-first serve $400,000 initial funding threshold.
