Rationale:
The next item on our agenda this evening is the annual Public Hearing on the Lincoln Public Schools Student Fees Policy 5520. Before we begin the hearing, I would like to note that staff has recommended changes to only Appendix "1" of the current policy and all of those proposed changes are set forth as an attachment at agenda item 10.1.3 for this meeting for anyone who wishes to review or comment on them.
I would first ask staff to give a brief report on the amount of money collected and use of waivers for the prior year. For those interested in speaking during this public hearing, the same guidelines apply as to public comment. Speakers should complete the blue contact card and present it to a staff prior to speaking. Speakers have a maximum of five minutes to speak. The Board does not engage in conversation with the speakers, but listens carefully to the comments as part of its collection of information for consideration of agenda items. With that, I hereby open this public hearing before the Board of Education of Lincoln Public Schools. This hearing is being conducted under the provisions of the Nebraska Public Elementary and Secondary Student Fee Authorization Act and other Nebraska laws. The purpose of this hearing is to receive input regarding proposed Policy 5520 and Appendix "1". The input received in this hearing will be taken into consideration by the Board when we take action on proposed Policy 5520 and Appendix "1". The mission of the association is to provide professional development and support for educational office professionals through networking, leadership, mentoring, recognition and fellowship.
Explanation: Here’s what a colleague said about Dr. Haeffner in a nomination letter: "Dr. Haeffner is the voice for libraries, librarians and literacy in our district. The American Psychological Association has honored Lincoln High School teacher Lindsey Herting with the Charles T. Blair-Broeker Excellence in Teaching Award. This award recognizes the best high school psychology teachers in the country. She is one of only three teachers in the country to win the award this year. Herting teaches Advanced Placement and International Baccalaureate psychology at Lincoln High
The American Psychological Association has honored Lincoln High School teacher Lindsey Herting with the Charles T. Blair-Broeker Excellence in Teaching Award. She’s one of only three teachers in the country to win the award this year. LPS Assessment/Evaluation Specialist Rob McEntarffer and K-12 Social Studies Curriculum Specialist Jaci Kellison nominated Herting for this award. McEntarffer and Kellison wrote in their nomination letter: "Not only is she a strong leader when working with teachers, she also creates positive working relationships with teachers from other schools. Through her patience, experience and willingness to listen and collaborate, she has earned the respect of psychology teachers throughout Lincoln Public Schools, in Nebraska and across the country." Former student Olivia Haller said this about Herting: "Ms. Herting is one of those teachers who stands out because she embodies more than just the title of teacher. Rationale:
On February 11, 2020, the Board adopted a resolution to accept option enrollment students for the 2020-21 school year. An application for enrollment during the 2020-21 school year had been received and is in compliance with the Board resolution of February 11, 2020.
Explanation The application included in this agenda item has been examined by staff and meets one of the criteria set forth by the Board in the resolution of February 11, 2020. Staff recommends approval of the application. Proposal That the Board adopts the following resolution: WHEREAS, the student who has been assigned student number 436429 (for purposes of confidentiality, an assigned number is being used) meets one or more of the criteria of the Board resolution of February 11, 2020, with regard to such option students; THEREFORE, BE IT RESOLVED that the aforementioned student be accepted as an option student on the condition and with the express understanding that all programs, all classes and all buildings of assignment, except as otherwise required by law, shall at all times and from time to time during attendance at Lincoln Public Schools be determined solely by Lincoln Public Schools.

The Open Meetings Act requires and the intention of the Board is that agenda items be sufficiently descriptive to give the public reasonable notice of the matters to be considered at the meeting. 10.1.1. Naming New High School in Northwest Lincoln
Rationale:
As directed by Policy 3997 and Regulation 3997.1, a committee of twelve (12) community members (Randy Bretz, Rich Claussen, John Goodwin, John Harris, Randy Hawthorne, Dayna Krannawitter, Marian Price, Willie Shafer, Tammy Ward, George Weaver, Larry Wright, and John Yoakum) and three (3) Board members (Don Mayhew, Barbara Baier, and Annie Mumgaard) solicited and reviewed suggestions for names of the new high school to be built in northwest Lincoln at NW 48th and West Holdrege Streets. Over 200 names were suggested by more than 900 individuals. The committee met over the course of several weeks to discuss the submissions and make a recommendation to the Board.
Explanation
The committee unanimously recommended that the new LPS high school in northwest Lincoln be named Lincoln Northwest High School. Proposal That the Board thank the community members of the School Naming Committee for their thoughtful service, and that the Board receive and discuss the committee’s recommendation for Lincoln Northwest High School. |

10.1.2. Policy 5520 - Students - Student Fees
Rationale:
The Board of Education of Lincoln Public Schools annually reviews and approves Policy 5520 to ensure that its policy is in accordance with the Public Elementary and Secondary Student Fees Authorization Act.
The district’s general policy is to provide for the free instruction in school in accordance with the Nebraska Constitution and state and federal law. This generally means that the district’s policy is to provide free instruction for courses that are required by state law or regulation and to provide the staff, facility, equipment, and materials necessary for such instruction without charge or fee to the students. The district does provide activities, programs, and services to children that extend beyond the minimum level of constitutionally required free instruction. Students and their parents have historically contributed to the district’s efforts to provide such activities, programs, and services. The district’s general policy is to continue to encourage and to the extent permitted by law, to require such student and parent contributions to enhance the educational program provided by the district. Explanation Revisions to Policy 5520 reflect changes to fees and the fee waiver eligibility to address changes in cost while remaining in compliance with all applicable laws. Proposal That the Board discuss revisions to Policy 5520 and Appendix 1.

10.2.1. Title VI, Indian Education Program
Rationale:
The U.S. Department of Education through Title VI of the Every Student Succeeds Act (ESSA) provides funds to fulfill the federal government’s responsibility to the Indian people for the education of Indian children. These funds support the goal of ensuring programs that serve Indian children are of the highest quality and provide for not only the basic elementary and secondary educational needs, but also the unique educational and culturally related academic needs of these children.
Lincoln Public Schools has received federal funds for services for Native American students since the mid-1980’s. The following table reflects an annual student count and the grant award amount received in recent years. Grant award amounts vary by year according to the total amount of Indian Education funds available at the federal level and are not based only on the number of students per program.
Explanation:
Lincoln Public Schools Indian Education program will provide support to Native American students in grades PK-12 in the 2021-22 school year. Native American students are enrolled in all schools across the district representing about 60 tribes as designated by the parent. Estimated funding from Title VI for 2021-22 is $164,298, based on the February student count. Decisions regarding the use of these funds are made in consultation with the Native American Advisory Committee. Proposal: That the Board approve the submission of the required application of the Indian Education grant to the U.S. Department of Education for $164,298. No district-funding match is required.
This grant application is due May 14, 2021. |

10.2.2. Computers for High School and Middle School Labs #10182
Rationale:
The CLASS technology plan provides budget resources in the 2020-21 fiscal year to continue the practice of providing two labs of Apple desktop computers at each high school and one lab of Apple desktop computers at each middle school. These desktop computers support coursework in visual art, photography, business applications, and music production. The proposed equipment also includes a new monitor for each desktop computer.
Explanation
Coursework in visual art, photography, business, and journalism require the use of application software from Microsoft and Adobe and these applications don’t run on Chromebooks assigned to students. Additionally, the work performed with these applications benefits from a full-size, high-resolution monitor. The proposed hardware includes the latest Mac Mini computers and Dell 24" monitors. It is recommended that the Board award $560,880.00 to Apple (Cupertino Way, California) for the purchase of 720 Mac Mini computers and award $94,284.00 to Dell (Round Rock, Texas) for the purchase of 720 Dell 24" Monitors.
This will be an expenditure of $655,164.00 from the Federal, General, Depreciation, and Special Grants Funds. Proposal That the Board discuss the proposed purchase with an award to each of the listed vendors. The proposed purchase and deployment timeline were reviewed with the Board Student Learning & Technology Committee. The Board, by approving this purchase with Apple and Dell, is approving the provisions of the agreement and all associated documents related thereto according to the terms and conditions as presented or such other or additional terms and provisions as negotiated and approved by the Associate Superintendent for Business Affairs or a designee, and the Board is hereby delegating to and authorizing the Associate Superintendent for Business Affairs or a designee to sign, execute, and deliver such documents, and to take or cause to be taken any and all other action and sign any other documents as may be necessary to complete the transaction, and to administer, operate, and implement the same on a day to day basis during its term as contemplated thereby, for and on behalf of this School District. The Board by approving these purchases hereby designates the Chief Technology Officer or another person as selected by the Superintendent or a designee from time to time as its program administrator under these purchase orders. |

11.1.1. Naming New Elementary School
Rationale:
As directed by Policy 3997 and Regulation 3997.1, a committee of eight (8) community members (Lynn Ayers, Tony Merritt, Todd Ogden, Marco Pedroza, Kim Robak, Ishma Valenti, Mailani Veney, and Colette Yellow Robe) and three (3) Board members (Connie Duncan, Kathy Danek, and Bob Rauner) solicited and reviewed suggestions for names of the new elementary school to be built in northeast Lincoln east of 102nd and south of Holdrege. Over 180 names were suggested by more than 500 individuals. The committee met over the course of several weeks to discuss the submissions and make a recommendation to the Board.
Explanation
The committee unanimously recommended that the next LPS elementary school be named for Ada Robinson, a long-time LPS educator and fixture at Clinton Elementary for many years. Ada worked with many families for multiple generations at Clinton, and families built trust for the school because of their relationships with her. She was a long-time supporter of the work and mission of the Malone Center and a leader in the area of equity work. She has served in leadership roles throughout the community. Proposal That the Board thank the community members of the School Naming Committee for their thoughtful service, and that the Board receive and approve the committee’s recommendation for Ada Robinson Elementary School. |

11.1.2. Evaluation and Proposed Compensation with the Superintendent of Schools
Rationale:
Annually, the Board of Education evaluates and reviews the contract of the Superintendent of Schools. The 2020-21 evaluation of Steve Joel, Superintendent, is in the process of being completed and will be recommended for approval to be placed in his personnel file, and his contract is being recommended for extension and compensation increase. Copies of a public summary of the Superintendent’s evaluation and the proposed contract for consideration are attached.
Explanation: It is recommended that the Board of Education consider and discuss the evaluation summary and that the current contract for the Superintendent be amended as attached.

Rationale:
Annually, the Board of Education reviews the contracts of the Associate Superintendent for Instruction, the Associate Superintendent for Business Affairs, the Associate Superintendent for Human Resources, the Associate Superintendent for General Administration and Governmental Relations, and the ESU 18 Administrator.
Explanation: It is recommended that the proposed three-year contract for each of the Associate Superintendents be amended and extended to June 30, 2024. It is also recommended that a total salary increase of 1.51 percent, overall total package increase of 1.60 percent, be approved for this group for 2021-22. Each contract is within the parameters set by the Board of Education. It is also recommended that the proposed 260 working days one-year contract for the Director of Continuous Improvement and Professional Learning and ESU 18 Administrator be amended and extended for the 2021-22 school year with a salary increase of 1.51 percent, overall total package increase of 1.60 percent for 2021-22. The contract is within the parameters set by the Board of Education. Included in the total package increase for each of the four Associate Superintendents and the ESU 18 Administrator are additional district costs including the district’s contributions to health insurance, state retirement, and Social Security. The proposed contracts are attached.

Rationale:
Each year, the Business Affairs Office makes recommendations to the Board of Education for tuition charges for regular and special education programs. This is done in accordance with Policy 3300 and Regulation 3300.1.
Explanation The following is the recommendation for tuition charges for the 2021-22 school year for the programs noted. The rates are intended to recover the district’s anticipated actual costs for the 2021-22 school year.

Rationale:
The Lincoln Board of Education is authorized by state statute to hold closed sessions. Closed sessions may be held when clearly necessary for the protection of the public interest or for the prevention of needless injury to the reputation of an individual. Reasons that meet this standard include but are not limited to: (a) strategy sessions with respect to collective bargaining, real estate matters, pending litigation, or litigation which is imminent as evidenced by communication of a claim or threat of litigation to or by the public body; (b) discussion regarding deployment of security personnel or devices; (c) investigative proceedings regarding allegations of criminal misconduct; (d) evaluation of the job performance of a person when necessary to prevent needless injury to the reputation of a person and if such person has not requested a public meeting; and (e) legal advice.
Explanation
At this point, it is appropriate for the Board to meet in closed session for one of the stated matters and/or any other permissible closed session matters in compliance with the law.
