4. In the event Hardin County election officials have determined  in their recount that the two highest candidates for Place One in the May 6, 2017, Trustee Election  - Ms. Kathy Merritt and Mr. Darrell (D.J.) Ferguson – did in fact receive the same number of votes, the Board will order a Second Election for Trustee, Place One.

5. In the event Hardin County election officials have determined in their recount that one of the two highest candidates for Place One in the May 6, 2017 election received more votes than the other, the Board will canvass the results of that election, issue a Certificate of Election to the winner, and direct that she or he be sworn in to serve in that position.

6. The open session of the meeting will recess and the Board of Trustees will convene in closed session for the following purposes.

6.A. The Board of Trustees may elect to meet in closed (executive) session to consult with its attorney regarding legal aspects of these matters, as permitted by section 551.071 (2),Tex. Gov’t Code.

7. Any action, decision, or vote on these matters will be taken in open (public) session, according to law.
