Description:
TEXAS GOVERNMENT CODE § 551.082
Sec. 551.082. SCHOOL CHILDREN; SCHOOL DISTRICT EMPLOYEES; DISCIPLINARY MATTER OR COMPLAINT. (a) This chapter does not require a school board to conduct an open meeting to deliberate in a case: (1) involving discipline of a public school child; or
(2) in which a complaint or charge is brought against an employee of the school district by another employee and the complaint or charge directly results in a need for a hearing.
(b) Subsection (a) does not apply if an open hearing is requested in writing by a parent or guardian of the child or by the employee against whom the complaint or charge is brought.

The Rains County Appraisal District submitted their 2024 Assessment/Collection Contract after their August meeting for our Board to consider. Administrative Considerations: This contract partners Rains ISD with the Rains County Appraisal District for the assessment and collection of taxes for 2024. Recommendation: Approve the proposed contract between Rains ISD and the Rains County Appraisal District for 2024. Board Action: Board approval.

V.B.3. Skyward Invoice, Purchase over $50,000- Board Policy CH(LOCAL)
Description:
Background:
Board Policy CH(LOCAL) states: The Board delegates to the Superintendent the authority to make budgeted purchases for goods or services. However, any single, budgeted purchase of goods or services that costs $50,000 or more, regardless of whether the goods or services are competitively purchased, shall require Board approval before a transaction may take place, except as otherwise provided in this policy. The Superintendent is not required to obtain Board approval for the following types of budgeted purchases, regardless of cost, but shall subsequently report them to the Board: 1. A purchase made pursuant to a Board-approved interlocal contract, in accordance with Government Code Chapter 791; 2. A continuing or periodic purchase under a Board-approved bid or contract; or 3. A purchase for food, fuel, or utilities. Administrative Considerations: The Skyward invoice is for the Annual License Fees for 9/1/23 - 8/31/2024 and is in the amount of $55,141.00 Recommendation: Approve payment of Skyward invoice #0000222423 in the amount of $55,141.00, as presented. In the TEA(Texas Education Agency) General Provisions and Assurances section GG.ITEM 6. states,"Availability of Information: That any Applications, evaluation, periodic program plan or report relating to each program will be made readily available to parents and other members of the general public (20 USC 1232 (e)). Federal Grant applications are to be made aware of to the public and the use of those funds if granted. V.D. Consider Approval of a Resolution Designating Non-Business Days During the Calendar Year of 2023 & Calendar Year of 2024
Description:
Background:
The 88th Texas Legislature recently passed House Bill 3033 (HB3033) to amend portions of the Texas Public Information Act(TPIA). The new legislation, HB3033, creates a new state definition of "business day" which limits the types and number of days that can be considered a "non-business day" for a public school district. Historically, the law has not provided a clear definition of a "business day" for entities- meaning districts have been able to rely on their own interpretation of a non-business day for purposes of public information deadlines. In the past, these types of "off days" have included both state/national holidays as well as local district closures, such as Fall/Spring Break, Fridays off during the summer, etc. HB3033 now states that, as a general matter, every day is a business day, EXCEPT for:
Note, under this new law, local school "holidays" such as Christmas Break and Spring Break are not automatically considered non-business days for purposes of receiving and responding to public information requests. Instead, the new law requires that the Board of Trustees take formal action to designate up to ten(10) school district non-business days (besides the "holidays" identified above) for purposes of the TPIA. Districts that historically close on Fridays during the summer months, or have frequent closures like bad weather days, Fall Break, etc. may quickly exceed the allowable 10 non-business days and may have to count some closure days as active business days for public information purposes. Recommendation: Consideration and approval of the resolution designating non-business days during the calendar year of 2023 and calendar year of 2024 for responding to Texas Public Information Act(TPIA) requests as presented. V.E.3. Consideration and Approval of Proposed Revisions to Policy FNCE(LOCAL)- Telecommunication Devices
Description:
Background:
The proposed amended Policy FNCE(LOCAL) attached to this board book reflects the proposed changes for consideration and approval. Changes are in red. Personal Use Telecommunications Devices An authorized District employee may confiscate a personal telecommunications device, including a mobile telephone, used in violation of applicable campus rules. The District shall not charge a fee for the release of a confiscated personal telecommunications device at an elementary A confiscated personal telecommunications device at a junior high or high school campus shall be released for a fee determined by the Board. In accordance with the student handbook, the student or the student’s parents may retrieve the device after paying the fee. If a personal telecommunications device is not retrieved, the District shall dispose of the device after providing notice required by law. Administrative Considerations: A fee of $10 is the proposed fee that a student or the student's parents may pay in order to retrieve the device for violating the policy. Recommendations: Approve the proposed changes to Policy FNCE(LOCAL) and a $10 fee as presented. Board Action: Board approval.

Description:
Background:
The Texas Education Code (TEC) 37.108 (c) requires Independent School Districts to report the results of their safety and security audits to the district's board of trustees and to the Texas School Safety Center. Administrative Considerations: Superintendent Johnson submitted the DAR summary report to the Texas School Safety Center on August 17, 2023. Recommendation: Review the DAR summary report submitted to the Texas School Safety Center. Board Action: Signatures are required for the cover page of the DAR Summary Report. |
