04-26: Terry J. Hite, 4433 North 14th Street. The applicants have requested to keep their existing driveway and parking pad as is. 4433 North 17th Street is within Zoning District R-1 (Urban Residential Single-Family District), which allows 50% Building Coverage and 60% Impervious Coverage. The setbacks for Zoning District R-1 are as follows:
Front yard = 25 feet
Side yard = 5 feet
Street side yard = 20 feet
Rear yard = 25 feet
Max. height = 35 feet
The applicants' request is to be granted a variance for their noncontinuous hard surface vehicular access to their new detached garage addition, allowing them to keep their property as is. (Notice of public hearing on September 28, 2026 published in The Daily Nonpareil on September 24, 2026.)CODE REFERENCE - CARTER LAKE, IA CODE OF ORDINANCES: 69.06 PARKING PROHIBITED. 18. Parking or Terrace. No person shall drive upon or park a vehicle between the curbing of any hard surfaced street and the sidewalk, unless said hard surfaced with concrete, asphalt, or other hard surfacing, except during a declared emergency snow removal.
170.03 RESIDENTIAL OFF-STREET PARKING. 1. At the time of major repair, replacement, construction, or enlargement of a structure or major repair, replacement or enlargement of the parking surface, a hard-surfaced parking area, other than the street or public way, shall be provided for use in the storage of passenger automobiles.
2. Parking Provisions for Personal Vehicles. All vehicles in one-, two-family, and multi-family residential uses shall be parked or stored in the following manner, unless otherwise permitted herein:
D. Parking is permitted in the side yard or in the rear yard, behind the required front yard setback and must be contiguous with the primary surfaced driveway. However, this provision is not intended to prohibit the permitted parking in the driveway.
