III.b. NDSBA opinion on Purpose in policies
Description:
Hi Carly,
I’m with you - consistency is best. And to be honest, while I do see some template policies coming out with "purpose" sections, not all NDSBA templates have purpose sections included. At least here at the NDSBA, I suspect the reason for even our internal inconsistency is because we have hundreds and hundreds of policy templates that have been touched by many hands (and opinions) over numerous years. For me, purpose statements make the most sense only if (1) there is a policy with a law that requires the policy to be in place (i.e., the purpose statement might address that law that requires the policy) or there is a law that requires a school district to have a declaration/prohibition against certain conduct (e.g., antidiscrimination statement/ antiharassment statement). However, even then we might use the heading "General Prohibition" (e.g., policy AAC - Nondiscrimination and Anti-Harassment). Or we might just start the policy with a "Definitions" section and then move into "Prohibited Action" (e.g., ABCE - Prohibition on Aiding Sexual Abuse). Since the law does not speak to purpose statements one way or another, my personal opinion is that if a purpose statement is ever included, it should serve an actual purpose. I wouldn’t recommend revising policies to include "purpose" statements just because. There should be a reason for the purpose statement that is useful to the reader/audience. Policies can operate just fine without purpose statements as long as the reason for the policy is already supported in other language within the policy. Most policies make their purposes clear through other language in the policy. I hope that makes sense. KrisAnn Norby-Jahner
