responsible for those aspects of governance and management required by statute and regulation, the board will consider the approval of a number of routine items listed on the consent agenda with a consolidated motion. Board members have the opportunity to review these items prior to each meeting and specific questions can be answered at that time. Public Content:  The Construction Manager At Risk (CMAR) Agreement with McCownGordon Construction LLC is a standard agreement that should have been signed after the Board approved the CMAR and passed the resolution to proceed to a bond election. 
The AIA Document A133-2019 is a standard form of agreement between Owner and Construction Manager, and is intended for use on construction management projects where the basis of payment is the Cost of the Work plus a Fee with a Guaranteed Maximum Price. This document is intended for use on construction projects where a Construction Manager, in addition to acting as an advisor to the Owner during the preconstruction phase, also provides construction of the project with a guaranteed maximum price. The Construction Manager provides the Owner with a Guaranteed Maximum Price proposal which the Owner may accept, reject, or choose to negotiate. Upon the Owner’s acceptance of the proposal by execution of the Guaranteed Maximum Price Amendment (Exhibit A), the Construction Manager becomes contractually bound to provide labor and materials for the Project and to complete construction at or below the guaranteed maximum price The Construction Manager’s services under this document are divided into two phases: the Preconstruction Phase and the Construction Phase, portions of which may proceed concurrently. A133-2019 also includes an Insurance and Bonds Exhibit (Exhibit B), which is a critical part of the agreement.

Although the bond failed, should the Board determine whether to move forward with future new construction or improvements to Burlington Elementary School, McCownGordon Construction, LLC would be the CMAR until the agreement expires on September 30, 2026.  If a new Burlington Elementary School project were approved, Exhibit A would be amended to define the scope of the work. The agreement may be adjusted if service extends beyond September 30, 2026.

Public Content:  Lanette will have been an Elementary School Teacher for 35 years.  All 35 years have been with USD 244.

Public Content:  Craig has been a teacher, coach, and administrator over the course of 35 years. Ten of those years have been with USD 244 as Superintendent.

Public Content:  Jeanne will have been an employee of USD #244 for 29 years at the end of the 25/26 school year. She began with the Coffey County Special Education Cooperative as a Paraprofessional for 10 years and is completing her 19th year as a Special Education Teacher.

Public Content:  The Board may want to consider working with an independent firm to assist with the search for a new Superintendent of Schools.  Possible firms include KASB, Greenbush, and McPherson & Jacobson, LLC.  The Board could also put out a public notice for Request for Proposals (RFP) or choose a different firm to assist in the search. Lastly, the Board can conduct the Superintendent search independently.
