IV. Consultation with attorney in closed session under Texas Government Code §551.071 regarding possible litigation regarding to the removal of the communications pole on District property as part of the Region 17 Information Network (the “Consortium”).

Deliberation and possible action to adopt a resolution authorizing the engagement of the services of the Underwood Law Firm, P.C., or another law firm as determined by and the Consortium and/or Region 17 ESC, as fiscal agent for the Consortium, to file suit against Conterra (and/or any other party relating to the February 19, 2010, Region 17 WAN Telecommunications Service Agreement and Network) on the Districts’ behalf either individually or together with one or more of the members of the Consortium and Region 17 ESC.
