EXECUTIVE SESSION NOTICE IS HEREBY GIVEN that the Board of Education of the Española Public Schools will meet in Closed Executive Session Pursuant to NMSA 1978, Section 10-15-1 (H) (2) of the New Mexico Open Meetings Act, specifically to discuss (a) the contract of Superintendent Fred Trujillo who is on leave with pay, and (b) the pending investigation of performance-related questions prompted by the allegations contained in the recent Garrity v. Pecos ISD, Fred Trujillo, et al legal claim, which was filed in the U.S. District Court for the District of New Mexico on May 4, 2021, as they may relate to or impact Española Public Schools.

DISCUSSION AND ACTION ITEMS

Discussion and possible action regarding Superintendent investigation and/or Superintendent contract.

Discussion and possible approval of Board Member Vacancy Announcement (for Board Seat, District 1).

Discussion and possible approval of a media plan to include posting vacancy announcement on District website, on District social media, and provide to local media outlets (for Board Seat, District 1).

Discussion regarding whether to conduct interviews of qualified candidates and format for interviews (for Board Seat, District 1).

Discussion and possible approval of Checklist for filling Board Member Vacancy (for Board Seat, District 1) including dates/deadlines for:

the Interim Superintendent or designee to publish and post the Vacancy Announcement according to the media plan;

interested candidates to submit the completed interest packets;

the Interim Superintendent or designee to send to the Board for review the qualified candidate interest packets;

the Interim Superintendent or designee to notify all qualified candidates of the time and place for the interviews (if any); and

the Board meeting to conduct the interviews (if any), discuss and take possible action to fill the vacant Board seat, and swear in the new member.
