3. KNA-Immigration Enforcement on MESD Property-Required
In 2026, the Oregon Legislature adopted three bills related to federal immigration enforcement in schools: Senate Bill (SB) 1538, SB 1594, and House Bill (HB) 4079). These new laws require the Oregon Attorney General’s (AG) Office to publish model policies related to immigration enforcement in schools, which are available here. ESDs must provide these model AG policies to employees, and must adopt a policy that is consistent the AG model policies by September 30, 2026.

 

4. BBE-Vacancies on the Board-Optional
Boards often struggle establishing a procedure when there is a vacancy on the board. Consequently, OSBA has updated this policy to incorporate legal requirements into a set of steps boards can follow in order to fill the vacancy.

5. CBA-Qualifications and Duties of the Superintendent
There have been several changes to Oregon Public Meetings laws over the last few years. These include statutes from the Oregon Legislature and rules from the Oregon Government Ethics Commission. In 2026, the Legislature passed House Bill 4177, but it will not go into effect as it was vetoed by the governor. The policies included in this update include language that matches the new laws. 

6. EBB-Integrated Pest Management
House Bill 2684 (2025) added some new provisions to law for Integrated Pest Management Plan requirements. One new provision requires posting the list of low-impact pesticides to the website or in the Healthy and Safe Schools Plan; the second requires a review of a IPM plan every five years to identify updates, if any, and readoption; and lastly, to post the IPM plan to the website or include it in the Healthy and Safe Schools Plan and post it to the website. 

7. EBBA-Student Health Services
Senate Bill 2948 (2025, now in ORS 342.458) added language regarding nurse delegation. This update reflects the new language. 

8. GBN/JBA & JBA/GBN-Sexual Harassment
Multiple laws address sexual harassment in Oregon schools. Oregon laws include requirements to provide notice to individuals involved in reports of sexual harassment. This update is to clarify these notice requirements. 

9. KNA-Cooperation with Private Enterprises
With the release of the new Board Policy KNA – Immigration Enforcement on MESD Property, MESD will need to recode the current Board Policy KNA – Cooperation with Private Enterprises. After consultation with OSBA Policy Services, it is recommended that Cooperation with Private Enterprises be recoded as Board Policy KNB.

This policy is referenced in New Board Policy KNA and was due for a review.  Most changes are in the legal references with updated OAR references
