Description:
a. Private school placements will get more money if they are in Special Education. This will very likely increase the amount of evaluation requests we are getting from parents. We can still deny if there is not a need or a suspicion of a disability; but we need to be sure the PWN is legally defensible and covers both prongs of eligibility. It will be critical to follow all the guidelines for the parent request timelines, etc.
b. Surveillance could be in resource classrooms if your school is still offering most core subjects "instead of" for more than 50% of the kids in a room. c. In the past, we did not do the MDR if a student withdrew during the process; but now, we need to per HB 6. d. Many of your dyslexia specialists came at the beginning of the year to do training in IEP writing, but know that we can offer additional training, and ESC 12 has some good training as well. e. TEC 29.0031 outlines if the district does not have an LDT, another person who holds the most advanced dyslexia-related certification issued by an association recognized by the SBOE, or that person is not available, then the LEA may identify another individual to serve in the role. Within one calendar year from the date being designated (page 29 of Dyslexia Handbook), this individual must complete the following: • register and complete the Texas Education Agency’s (TEA’s) Texas Dyslexia Academies (TDAs); • register and complete the TEA’s Guidance for the Comprehensive Evaluation of a Specific Learning Disability training; and • document that the member has training in current research and evidence-based assessments that are used to identify the most common characteristics of dyslexia (see page 72, Q4, for more information). Individuals who have been appointed will have a year from May 12, 2025 to complete the Guidance for the Comprehensive Evaluation of a Specific Learning Disability on-line training.
