H.16. Contract Extension with Humana Employee Assistance Program (EAP) and Work Life Services
Rationale:
The District recommends that the Board approve a three year contract (through May 31, 2023) with Humana, Inc. in the amount of $87,602.64 per year (for a total of $262,807.92 over three years) to continue to provide Employee Assistance Programs for staff. This benefit for all employees would continue to provide up to five (5) sessions for employees or their families in addition to Work Life Services, personal financial and personal legal consultations and a member website to provide online resources for employees.

H.17. Children's Literacy Initiative Consulting Agreement
Rationale:
The OPS early literacy vision statement calls for all teachers and instructional leaders to model a love of reading and feel confident in their abilities to teach, lead and support early literacy learning so that all students develop a love of reading and writing. The intention is for students to be offered multiple opportunities each day to engage in meaningful conversations around high-quality, culturally responsive texts and to develop the love and joy for reading to become lifelong readers, writers, and thinkers. It is our vision that all children will be reading and writing on grade level by the end of third grade and beyond. This work is being funded through a grant.

Rationale:
Staff recommends approval of the attached Settlement Agreement between Omar Ortega-Gomez, the Omaha Public Schools and Bitco Insurance Companies. Mr. Ortega-Gomez filed a tort claim alleging that he was injured by a school bus owned and operated by OPS while he was working on October 9, 2017. The tort claim was subsequently withdrawn and litigation filed in Douglas County District Court. Bitco Insurance Companies is a necessary party as the work comp carrier for Mr. Ortega-Gomez’s employer.

K. Request for Closed Session
Rationale:
The Omaha Board of Education is authorized by state statute to hold closed sessions. Closed sessions may be held when clearly necessary for the protection of the public interest or for the prevention of needless injury to the reputation of an individual. Reasons that meet this standard include but are not limited to: (a) strategy sessions with respect to collective bargaining, real estate matters, pending litigation, or litigation which is imminent as evidenced by communication of a claim or threat of litigation to or by the public body; (b) discussion regarding deployment of security personnel or devices; (c) investigative proceedings regarding allegations of criminal misconduct; (d) evaluation of the job performance of a person when necessary to prevent needless injury to the reputation of a person and if such person has not requested a public meeting; and (e) legal advice.
Explanation
At this point, it is appropriate for the Board to meet in closed session for one of the stated matters and/or any other permissible closed session matters in compliance with the law. That the Board hold a closed session: 1. For strategy session with respect to negotiations/collective bargaining clearly necessary for the protection of the public interest or for the prevention of needless injury to the reputation of an individual in compliance with the law. 2. For strategy session with respect to property/real estate matters clearly necessary for the protection of the public interest or for the prevention of needless injury to the reputation of an individual in compliance with the law.
3. For strategy session with respect to pending litigation, or litigation which is imminent as evidenced by communication of a claim or threat of litigation to or by the public body clearly necessary for the protection of the public interest or for the prevention of needless injury to the reputation of an individual in compliance with the law.
4. For discussion regarding deployment of security personnel or devices clearly necessary for the protection of the public interest or for the prevention of needless injury to the reputation of an individual in compliance with the law.
5. For investigative proceedings regarding allegations of criminal misconduct clearly necessary for the protection of the public interest or for the prevention of needless injury to the reputation of an individual in compliance with the law.
6. For personnel and the evaluation of job performance clearly necessary for the protection of the public interest or for the prevention of needless injury to the reputation of an individual in compliance with the law.
